1. Introduction

Welcome to SayonaraSale ("the Platform", "we", "us", or "our"). SayonaraSale is an online classifieds platform designed to connect expatriates leaving Japan ("Sellers") with buyers ("Buyers") who wish to purchase secondhand goods within the Tokyo metropolitan area. By accessing or using SayonaraSale, you agree to be bound by these Terms and Conditions. Please read them carefully before using the Platform.

2. Eligibility

To use SayonaraSale, you must:

  • Be at least 18 years of age.
  • Have the legal capacity to enter into a binding agreement.
  • Provide accurate and truthful information during registration.
  • Comply with all applicable local, national, and international laws and regulations.

We reserve the right to suspend or terminate accounts that do not meet these requirements.

3. User Accounts

3.1 Registration

To list items or contact sellers, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update this information as necessary. SayonaraSale is not liable for any issues arising from inaccurate account information.

3.3 Account Termination

We reserve the right to suspend or permanently terminate your account at our discretion if you violate these Terms and Conditions or engage in conduct we deem harmful to the Platform or its users.

4. Listings

4.1 Creating Listings

Sellers may post listings for secondhand items they wish to sell. Each listing must include an accurate title, description, condition, price, and a valid Japanese address (at minimum to the chome level) within Tokyo. Listings may remain active for a maximum of 30 days, after which they are automatically and permanently deleted from the Platform.

4.2 Prohibited Items

The following items are strictly prohibited on SayonaraSale:

  • Illegal goods or substances of any kind.
  • Counterfeit or replica products.
  • Weapons, firearms, and dangerous materials.
  • Items that infringe on intellectual property rights.
  • Adult content or services.
  • Live animals.
  • Stolen property.

SayonaraSale reserves the right to remove any listing that violates these restrictions without notice.

4.3 Accuracy of Listings

Sellers are solely responsible for the accuracy of their listings. SayonaraSale does not verify the condition, authenticity, or legality of any listed item. Misrepresenting an item in a listing may result in account termination.

4.4 Listing Expiry and Deletion

All listings are automatically and permanently deleted 30 days after creation. SayonaraSale does not archive or store deleted listings. Sellers are responsible for marking items as sold before the expiry date. SayonaraSale accepts no liability for listings that expire before a transaction is completed.

5. Transactions

5.1 Platform Role

SayonaraSale is a discovery and connection platform only. We do not participate in, facilitate, guarantee, or take responsibility for any transaction between Buyers and Sellers. All negotiations, agreements, and exchanges take place entirely outside the Platform, primarily via WhatsApp or other communication methods chosen by the parties.

5.2 Cash Transactions

All transactions on SayonaraSale are expected to be conducted as cash-on-pickup arrangements. SayonaraSale does not process payments, hold funds, or provide any escrow or payment protection service.

5.3 No Buyer or Seller Protection

SayonaraSale provides no buyer protection, seller protection, dispute resolution service, or refund mechanism. Users transact entirely at their own risk. We strongly recommend that Buyers inspect items before completing payment and that Sellers only release items upon receiving full payment.

5.4 Meeting Safely

We strongly recommend that users meet in public places during daylight hours to complete transactions. SayonaraSale accepts no responsibility for any harm, loss, or dispute arising from in-person meetings arranged through the Platform.

6. Contact Information and Privacy

Sellers may optionally provide a WhatsApp number on their listings to allow Buyers to make contact. This number is only visible to registered and logged-in users of the Platform. SayonaraSale is not responsible for any misuse of contact information shared on the Platform. Users share personal contact details at their own discretion and risk.

7. Intellectual Property

All content on the SayonaraSale Platform, including but not limited to design, logos, text, and software, is owned by or licensed to SayonaraSale and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without our express written permission.

By uploading images or text to the Platform, you grant SayonaraSale a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content solely for the purpose of operating and promoting the Platform.

8. Prohibited Conduct

Users of SayonaraSale must not:

  • Post false, misleading, or fraudulent listings.
  • Harass, threaten, or abuse other users.
  • Attempt to circumvent the Platform's security or technical measures.
  • Use automated tools, bots, or scrapers to access the Platform.
  • Use the Platform for any commercial or business purpose without our prior written consent.
  • Attempt to collect personal data about other users without their consent.

9. Disclaimer of Warranties

SayonaraSale is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, completeness, or reliability of any listing or user-generated content.

10. Limitation of Liability

To the fullest extent permitted by applicable law, SayonaraSale and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of money, property, data, or goodwill resulting from transactions facilitated through the Platform.

11. Indemnification

You agree to indemnify and hold harmless SayonaraSale and its operators from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms and Conditions, or your violation of any third-party rights.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Tokyo, Japan.

13. Changes to These Terms

SayonaraSale reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
